Azcension Homes, LLC and its affiliates that display or link to these Terms of Use (collectively, “Azcension Homes,” “Azcension,” “we,” “us,” or “our”) provide these Terms of Use (the “Terms”). Certain affiliates, service partners (e.g., lenders, title/escrow, marketing platforms), or programs may publish their own terms; where posted by them, those terms govern for that entity or program.

These Terms apply to our websites, mobile or web applications, social media pages, email and SMS communications, and any other online services that link to these Terms (collectively, the “Sites”). As used herein, “you” and “your” mean individuals who interact with Azcension Homes. Capitalized terms not defined here have the meaning given in our Privacy Policy.

By accessing or using the Sites, you agree to be bound by these Terms. If you do not agree, do not use the Sites.

1) Ownership and Use of Content

The Sites and all content on them—text, graphics, photos, video, audio, designs, software, code, and other materials—are owned by Azcension or used under license, with all rights reserved. Licensed stock and music (e.g., from Shutterstock, Adobe Stock, or similar providers) are owned by their respective licensors and used pursuant to license.

Except as expressly permitted, reproduction, distribution, modification, public display, framing, or other use of Site content without our prior written permission is prohibited. You may print reasonable portions of the Sites for your personal, noncommercial use, provided you keep intact all proprietary notices.

2) Your Account and Acceptable Use

If you create an account on the Sites (“Account”):

Keep your username and password confidential and secure.

You are responsible for all activities under your Account.

You agree you have no ownership rights in your Account. We may suspend or terminate Accounts, restrict access, and remove data at any time if we believe you violated these Terms, applicable law, or program-specific terms.

Prohibited Conduct. You agree not to, and not to allow others to:

Use the Sites for unlawful, infringing, deceptive, or harmful purposes;

Upload or transmit malware, harmful code, or spam;

Attempt to gain unauthorized access to the Sites, other accounts, or systems;

Scrape, crawl, index, or harvest data from the Sites (except as permitted by robots.txt);

Interfere with or disrupt the Sites’ operation or security;

Impersonate any person or misrepresent your affiliation.

We may monitor use of the Sites to protect our rights, users, and services.

3) User Submissions & License

If you submit, upload, or post any content to the Sites or otherwise provide content to us (e.g., reviews, testimonials, photos, questions, messages, or other materials) (“User Content”), you represent and warrant that you own or have rights to that User Content and that it does not violate any third-party rights or applicable law.

You grant Azcension a worldwide, nonexclusive, royalty-free, perpetual, irrevocable, sublicensable license to host, use, reproduce, modify, adapt, publish, translate, distribute, perform, display, and create derivative works from such User Content for any lawful purpose, including marketing and improving the Sites, subject to privacy laws and our Privacy Policy.

4) Fair Housing

Azcension Homes conducts business in accordance with all applicable federal, state, and local fair housing laws. We provide equal professional service to all persons regardless of race, color, religion, sex, handicap, familial status, or national origin. Any models or images do not reflect a preference for homebuyers.

5) Third-Party Links, Services, and Tools

The Sites may link to third-party websites, tools (e.g., maps), platforms, or services that are not controlled by Azcension. We are not responsible for their content, policies, or practices. Your use of third-party services is subject to those third parties’ terms and privacy policies.

6) Electronic Communications; SMS Program Terms (Summary)

By using the Sites, you consent to receive electronic communications from us (email, website notices, in-app messages). If you opt in to our SMS programs, you agree to the program disclosures provided at opt-in (e.g., recurring messages, message & data rates may apply, message frequency varies, reply STOP to cancel/HELP for help, consent not a condition of purchase, carrier not liable for delayed/undelivered messages). See our Privacy Policy and the SMS section for full details. Program terms may be updated at any time.

7) Claims of Copyright Infringement (DMCA)

If you believe content on the Sites infringes your copyright, you (or your agent) may send a DMCA notice to request removal or blocking. Your notice must include all required elements under 17 U.S.C. §512(c)(3). Send notices to:

8) Disclaimers; Limitation of Liability; Indemnity

Site Information. The Sites may include forward-looking statements, community information, incentives, pricing, features, floor plans, photos, renderings, availability, energy claims, and other content that may be illustrative, approximate, or subject to change without notice. Your use of the Sites is at your sole risk.

AS-IS. TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITES AND ALL CONTENT ARE PROVIDED “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, ACCURACY, ADEQUACY, OR FITNESS FOR A PARTICULAR PURPOSE, OR THAT THE SITES WILL BE UNINTERRUPTED OR ERROR-FREE.

Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, AZCENSION HOMES, ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUCCESSORS, AND ASSIGNS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES; LOSS OF PROFITS, REVENUE, OR DATA; OR BUSINESS INTERRUPTION ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SITES OR ANY CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

Indemnification. You agree to indemnify, defend, and hold harmless Azcension Homes and its affiliates, and their respective officers, directors, employees, and agents from and against all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of the Sites; (b) your User Content; (c) your violation of these Terms or applicable law; or (d) your violation of any third-party right.

Some jurisdictions do not allow certain disclaimers or limits on liability. In such jurisdictions, the foregoing applies to the maximum extent permitted by law and does not affect your non-waivable statutory rights.

9) Availability; Void Where Prohibited

Not all products, services, communities, incentives, or programs described on the Sites are available in all areas or to all users. The Sites are not an offer where prohibited by law or where prior registration is required.

10) Governing Law; Venue; Time to Bring Claims

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules, except to the extent preempted by U.S. federal law. You submit to the exclusive jurisdiction and venue of the state courts located in Maricopa County, Arizona or the U.S. District Court for the District of Arizona for any dispute arising out of or relating to the Sites or these Terms.

Any claim or cause of action you may have arising out of or related to the Sites must be filed within two (2) years and one (1) day after the claim or cause of action arose, or be forever barred.

11) Suspension; Termination; Survival

We may suspend or terminate your access to the Sites at any time for any reason or no reason. Upon termination, Sections that by their nature should survive (including, without limitation, ownership, User Content license, disclaimers, limitations of liability, indemnity, governing law/venue, and claim time limits) will survive.

12) Changes to These Terms; No Waiver; Severability

We may update these Terms from time to time without prior notice. The “Last Updated” date above reflects the latest revision. Your continued use of the Sites after changes become effective constitutes acceptance of the updated Terms.

No waiver is effective unless in a writing signed by Azcension Homes. If any provision of these Terms is found invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect.

13) Privacy Policy; Additional Notices

Your use of the Sites is also subject to our Privacy Policy and Legal Notices & Disclosures, which include important information (e.g., energy, HERS, ZERH, incentives, schools, views) and SMS program terms. In the event of a conflict between these Terms and program-specific terms presented at the time of your participation, the program-specific terms will control for that program.
